Terms of Service

Account terms

• You are responsible for maintaining the security of your account and password
• You must provide a valid email address to create an account
• You must be a human — accounts created by bots or automated methods may be terminated
• You may not use the Service for any illegal purpose or to violate any laws
• You are responsible for all activity that occurs under your account

Payment and billing

• A free plan is available with usage limits as described on our pricing page
• Paid plans are billed in advance on a monthly or annual cycle
• All payment processing is handled by our authentication provider, Clerk. We never store payment card details
• We do not charge overage fees for occasional traffic spikes. If your usage consistently exceeds your plan limits for two consecutive months, we will contact you to discuss upgrading
• Fees are non-refundable except where required by law

Cancellation and termination

• You can cancel your plan at any time from your dashboard settings
• Cancellation takes effect at the end of your current billing cycle
• Upon cancellation, your account reverts to the free plan. If you wish to delete your account and all data, you can do so from your settings
• We reserve the right to suspend or terminate accounts that violate these terms, with or without notice
• When an account is deleted, all associated analytics data is permanently removed within 60 days

Service modifications

• We may modify or discontinue features of the Service at any time
• Price changes require a minimum of 30 days' notice via email
• We will make reasonable efforts to notify you of significant changes to the Service

Data ownership and privacy

• You own all analytics data collected from your websites
• We will never sell or share your data with third parties
• Our data handling practices are described in our Privacy Policy and Data Policy
• You are responsible for ensuring your use of Zenith complies with applicable privacy laws and for providing appropriate privacy notices to your website visitors

Tracking script

The Zenith tracking script is provided for embedding on websites you own or have authorisation to manage. You agree not to:

• Embed the script on websites you do not own or have authorisation to manage
• Modify the script to collect additional personal data beyond what Zenith provides
• Use the script in a way that violates the privacy of website visitors

Intellectual property

• The Service, its design, and underlying technology are the intellectual property of Zenith
• Your analytics data remains your property at all times
• You may not use the Zenith name, logo, or trademarks without prior written permission

Limitation of liability

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. To the maximum extent permitted by law, Zenith shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenue arising from your use of the Service.

Changes to these terms

We may update these terms from time to time. Material changes will be communicated via email to registered customers at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised terms.
